The Law Society estimates that one in three of us will die without a Will. Why? Many of us are superstitious and feel that it may be tempting fate.
A Will is a legal document that sets out your wishes regarding the distribution of your estate and the care of any children. making one is the only way to ensure that your wishes are carried out after your death.
Without a Will, the distribution of your estate may take much longer. This is known as dying intestate. Many assume that their estate passes to their surviving spouse but this is often not the case. This could cause unnecessary distress to the beneficiaries at an already stressful time. Disputes can be avoided if a valid Will is in place and your family are aware that you have drawn one up. Also where it has been stored.
Who can write your Will?
Will writing is not a regulated activity, and the best reassurance that the job will be done properly is to engage with a solicitor. This way you will be protected by the Solicitors Compensation Fund.
What is an “expression of wishes”? Do I need one?
In addition to making a Will, it is important if you have a pension that you complete an “expression of wishes” form. This form is available from your pension schemes administrator. A Will does not normally cover who should inherit a pension. An expression of wishes although not binding helps to guide the administrators to whom should receive the pension funds.
